
Buying and/or selling property can be a big life decision and it is important to ensure you have the right support to guide you through the process, including engaging an experienced legal firm to act on your behalf.
To ensure the process of buying and/or selling your property begins and continues to run smoothly throughout the entire process, there are a few tips you should keep in mind:
- Ensure your documents are reviewed by our office, who are experienced legal representatives, prior to signing, especially if you are considering purchasing a property. The Contract of Sale is legally binding and it can be difficult and/or costly to change the terms after it has been signed;
- When selling ensure that you have all necessary documents, such as current rate notices for the Council and Water Board, copies of all permits and insurance documents for building works – by a registered builder or Owner Builder, copies of notices from third parties or any other documents that may be relevant to the sale ready to send to your legal representative. If you are unsure whether a document may be required or not, ask your conveyancer or legal representative;
- If you are obtaining finance to assist you with your purchase, your Contract of Sale should be made subject to you obtaining a loan approval regardless of pre-approval being received;
- Promptly return documents to your legal representative, especially if a lender is involved. Most lenders have processing times and failure to provide the required documentation to them can result in due dates, including settlement dates, being delayed.
