These important legal notices, via hyperlink, accompany every email sent by a representative of Wightons Lawyers Pty Ltd ACN 007 191 086, a law practice acting as agent for Wightons Lawyers ABN 15 250 153 828 (Wightons, we and our). You may have reached this webpage and these notices by clicking on the hyperlink contained in an email received from Wightons.
2. These important legal notices (Legal Notices) accompany all emails and email attachments sent by a representative of Wightons (Email Correspondence). These Legal Notices are to be read together with our Email Correspondence.  These Legal Notices will prevail over Email Correspondence, to the extent of any inconsistency.

It is important that as a recipient of Email Correspondence, you read and familiarise yourself with these Legal Notices before taking any steps, or refraining from taking any steps, in relation to any Email Correspondence you receive from Wightons. We may, acting reasonably, amend these Legal Notices from time to time, without notice.  Such amendments will take effect and be binding on you on the date which is 7 days following the date on which the amended Legal Notices are published on our website.
4. Our Email Correspondence is confidential and for the use of the intended recipient(s) only. It may also be the subject of legal professional privilege.  Disclosure or forwarding of Email Correspondence to a third party may constitute a waiver of your legal professional privilege and prejudice your rights.  As such, legal advice should be sought before disclosure or forwarding Email Correspondence to any third party.
5. If you are not an intended recipient of Email Correspondence, any disclosure, duplication or use is unauthorised and prohibited, and we kindly request that you notify us as soon as practicable by emailing us at or calling (03) 5221 8777 and permanently delete the Email Correspondence you have received.
6. Email Correspondence containing bank account details (including our trust account details) may have been intercepted and/or altered by third parties (including criminals). If you are asked to transfer funds into our trust account or into any other bank account, please telephone our office to confirm the account details you have received from us are correct before making any transfer of funds.  To the maximum extent permitted by law, and subject to the Australian Consumer Law, we do not accept liability for any loss you incur should our Email Correspondence be intercepted and/or altered by third parties, outside our reasonable control.
7. We do not have any plans to change our trust account details. In the unlikely event that our trust account details change, and this is during a period in which you have dealings with Wightons, we will do more than just send you an email notifying you of this.  Rather, we will take extra steps to notify you of our updated trust account details, such as contacting you by phone or in person.
8. If at any time you receive an email communication which appears to be from Wightons and you are not certain as to whether it is authentic and/or has been intercepted, please contact us by calling (03) 5221 8777 before opening or downloading the email or any link, file or attachment contained the email communication. Furthermore, please do not take any step, or refrain from taking any step, until you have confirmed authenticity.
9. Email Correspondence may contain links to third party websites. Any such links are provided solely for your convenience and do not indicate, expressly or impliedly, any endorsement by us of the sites or the information, products or services provided at those sites.  To the maximum extent permitted by law, and subject to the Australian Consumer Law, your access of those websites and your use of the information, products and services made available at those websites will be solely at your own risk.
10. To the maximum extent permitted by law, and subject to the Australian Consumer Law, Wightons does not represent or warrant that our Email Correspondence is virus or fault free. We recommend that you review our Email Correspondence to ensure it does not contain and is not affected by viruses or faults before clicking on any links or downloading any files contained in our Email Correspondence.
11. Wightons email inboxes are not monitored constantly and emails to Wightons recipients may not always be responded to in a prompt manner. For example, emails received by a Wightons recipient outside business hours, on public holidays or while the recipient is on annual leave, may not be responded to in a prompt manner.  You may receive an auto-reply from a Wightons recipient alerting you to these circumstances, but we cannot guarantee that you will.  Should you require that your email be acted upon promptly, please telephone us on (03) 5221 8777 after sending to convey this requirement.
12. Wightons scans incoming emails for viruses, scams and fraudulent conduct. From time to time, your emails (including replies to Wightons emails) may be captured by this process and may not be delivered to the intended Wightons recipient.  Should you seek that your email be acted upon immediately, please telephone us on (03) 5221 8777 after sending to ensure it has been received by the intended Wightons recipient and to request that it receives immediate attention (noting that this cannot be guaranteed by Wightons in every instance).
13. Our Email Correspondence includes registered trade marks and trade marks which are the subject of pending applications or which are otherwise protected by law, including but not limited to the word “WIGHTONS” and the “W” logo.
14. From time to time, Email Correspondence may be sent by a Wightons representative acting in a personal capacity and not on behalf of Wightons. Such Email Correspondence may contain opinions and views which do not necessarily reflect the opinions and views of Wightons.
15. The use of email communication carries with it inherent cybersecurity and other risks for both the sender and recipient. Wightons is committed to a reasonable standard of care and diligence in using email communication.  However, to the maximum extent permitted by law, and subject to the Australian Consumer Law, Wightons will not be liable for any loss you suffer which arises from your receipt of Email Correspondence or use of email communication in relation to Wightons, to the extent such loss is beyond the reasonable control of Wightons.
